Dominion Dealer Solutions, LLC and its affiliates (collectively, “Dominion”, “us”, “our” or “we”) own and/or operate a number of websites and applications that offer various solutions for automotive dealers. We believe that when you visit our websites and applications, you should know what personal information we collect from or about you and how we use it. To further that purpose, we provide this Privacy Policy, which explains our information practices and the choices you can make about the way in which your information is collected and used on this website, any other website operated by us where this policy appears or is otherwise accessible by you (for instance, via links from the website) and/or via any software applications we have created and made available for your use on your mobile device(s) (such websites and applications are, collectively, the “Services”).  (Some of our Services may also be governed by separate or additional privacy policies.)

regarding your information and how we will treat it. This Privacy Policy, together with our Terms of Use, forms an integral and binding part of our relationship with you. By using our Services, you agree to the terms of this Privacy Policy and our Terms of Use. If you object to our data collection practices or any of the provisions in this Privacy Policy, your choice is to stop using our Services.

 

Updates and Effective Date


We reserve the right to make changes to our Privacy Policy from time to time for any reason. If we make a change to this Privacy Policy that materially reduces your rights or significantly changes the way we use or share your personal information, we will notify you via a banner or similar display on our Services. If you object to any of the changes we make, your choice is to stop using our websites or apps. By continuing to use our Services following the effective date of such changes, you agree to our Privacy
Policy as modified.

 

The Information We Collect

When you use our Services, we collect a variety of information from and about you and your device, including information that identifies you directly. This section describes what information we collect in connection with your use of our Service .

Information You Provide

You can generally browse our Services without creating an account or providing your personal information. However, while using our Services, you may be able to search or buy products or services, enter promotions, sweepstakes or other contests, participate in a survey, complete a questionnaire or other “information request” form, or otherwise subscribe to one of our services such as our online newsletters, participate in one of our online forums/communities, express an opinion or communicate with our customer service.  In order to utilize, participate in or otherwise access such products, services or other offerings, you may be required to provide us with your personal information, which is information that, alone or in combination with other information, allows us to identify you, such as your name, address, phone number, e-mail address, contact preferences, credit card information, financial information or information relating to a support or service issue.

In addition, when you download, register and/or use any of our software applications (each, an “Application”), you may provide us with some or all of the following information:  (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as when you make purchases or respond to any offers via the Application; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Application, where applicable, and any third-party products or services available through the Application; (e) information you enter into our system when using the Application, such as contact information; and (f) when you interact with the Application as an employee of one of our business customers, information regarding your employer.

Automatic Collection

When you use on of our Applications, the Application may collect certain information automatically, such as the type of mobile device you use, your mobile devices’ unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use and information about the way you use the Application.  The Application may also collect precise information about the location of your device using your device’s global positioning system technology.  We may use your location information to provide requested location services, and to market certain of our products and services to you.  If you don't want us to collect this information, you can opt out by managing your location preferences either from the Application, where applicable, or via your mobile device settings.

Cookies and Other Tracking Tech

We may use various tools, including cookies, pixel tags, web beacons and other similar technologies, to gather behavioral analytics, including information about how you view and use our sites and apps, and to enhance your experience with our services. For example, many of our web pages use cookies to help us understand site usage and browsing patterns, improve the content and offerings on our websites and apps, or personalize your experience (e.g., to recognize you by name when you return to our websites, save your password in password-protected areas and enable you to use shopping carts on our websites. Cookies are text files we place in your computer’s or mobile device’s browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or reveal other personally identifiable information unless you choose to provide this information to us by, for example, registering at one or more of our websites. However, once you choose to furnish us with personal information, this information may be linked to the data stored in the cookie. Web beacons or clear .gifs are small pieces of code placed
on a web page to monitor behavior and collect data about the visitors viewing a page. For example, Web beacons or similar technology can be used to count the users who visit a website or to deliver a cookie to the browser of a visitor viewing that page.

Non-Personal Information

We also may collect, store and use certain non-personally identifiable information we receive when you use our Services, and we may aggregate data and information provided by or collected from multiple users (which may include you) in a manner that is not personally identifiable to any individual user.  All non-personally identifiable information collected by us through our Services and all aggregated/compilations of data we create are the exclusive property of Dominion.  Nothing in this Privacy Policy limits our right to use any such non-personally identifiable or aggregated information in any way (including, but not limited to, monitoring user traffic patterns, analyzing and quantifying user preferences, improving the design and content of our Services, and enabling us to personalize your user experience) or prohibits us from sharing non-personally identifiable or aggregated information with third parties.

Google® Ads

Some of our Services may use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven’t completed a task on our site, for example using the contact form to make an inquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to a website. Of course, any data collected will be used in accordance with our own privacy policy and Google’s privacy policy. You can set preferences for how Google advertises to you using the Google Ad
Preferences page to opt out of interest-based advertising.

 

Use of Information

We primarily use your information to respond to your request or otherwise fulfill or meet the reason for which the information is provided to us.  For example, if you request information regarding one of our products or services, we will use the information you provide (such as email) to contact you to schedule a demo.  

We also may use information collected from or about any website visitor or app user to provide and improve our website or app, including to analyze website traffic, app usage, and troubleshoot technical issues.

To the extent permitted by applicable law, we may also use information that we collect about you or that you provide to us, including any personal information, as follows:

  • To contact you about our products or services that may be of interest to you;
  • To manage our relationship with you, such as asking you to take a survey or provide feedback on our products and services;
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us;
  • To notify you about changes to our products and services or new products and services we offer;
  • To administer and protect our business and this website, including data analysis, testing, system maintenance, support, reporting and hosting of data; 
  • To enforce our legal rights and to protect the rights, property, or safety of Dominion, our clients, or others; and/or
  • For any other purposes with your consent.

Disclosure of Information

We disclose your personal information to unaffiliated third parties when you request or instruct us to do so.  We also may disclose information that we collect about you or that you provide us, including any personal information, as follows:

  • Business Providers; Unaffiliated Businesses: At times, we may provide products, services or offerings through our Services in cooperation with an unaffiliated third party.  We may share personal information that you provide in connection with any such products, services or offerings with the unaffiliated third party(ies) involved in your particular product, service or offering.  For instance, when you express interest in products, services, promotions, contests or sweepstakes that we offer (for example, by completing a request for or information regarding such services or completing an entry form for a promotion), we will share your request or expression of interest with the businesses with which we partner to offer you those products, services, promotions, contests and sweepstakes and, as applicable, with their affiliates and third party finder or marketing companies (collectively, “Business Providers”).  By electing to participate or otherwise expressing interest in any such product, service or offering conducted in conjunction with any Business Provider, you expressly authorize us to provide your personal information to those Business Providers.  Please be aware the Business Providers with whom we share your personal information may retain or use your information whether or not you use their services, and the privacy and information sharing practices of such Business Providers may differ from those described in this Privacy Policy.  Additionally, we may share personal information with unaffiliated third parties to whom you explicitly ask us to send your information.  If you prefer not to be contacted by any such Business Provider or other third party with whom we share your personal information, you may follow the “unsubscribe” instructions provided in any email you receive from any such third party.  In addition, you may opt-out of our sharing your personal information with Business Providers and other third parties by following the instructions on our Email Opt Out Form, as described below under “Privacy Choices”.
  • Third Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples may include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments and providing customer service. In connection with their performance of functions on our behalf, we may share personal information with such companies and individuals as needed for them to perform their functions, but we do not permit such entities and individuals to use personal information for other purposes. In addition, we may provide non-personal information to advertisers and other third parties for their use in marketing efforts for us, themselves, or others.  If you are not interested in receiving targeted advertisements or other marketing information or materials as a result of such efforts, you may adjust the settings on your mobile devices to prevent the use of your non-personal information in this manner.
  • Third Party Promotions: We may send offers to selected groups of customers on behalf of unaffiliated businesses that want to market their products or services to you, and as part of these promotional offers we may sell or disclose certain of your personal information to such unaffiliated businesses.  If you prefer not to be contacted by any such business with whom we share your personal information, you may follow the “unsubscribe” instructions provided in any email you receive from any such third party.  In addition, you may opt-out of our sharing your personal information with such businesses by following the instructions on our Email Opt Out Form, as described below under “Privacy Choices”.
  • In-House Promotions:  We may on occasion combine information we receive through our Services with outside records to enhance our ability to market our products and services that may be of interest to you.  If you have signed up to receive our e-mails and prefer not to receive marketing information in connection with our Services, please follow the “unsubscribe” instructions provided on any marketing e-mail you receive in connection with our Services or by following the instructions in our Email Opt Out Form, as described below under “Privacy Choices”.
  • Business Transfers: As our businesses continue to evolve, we might explore the reorganization or sale of one of our companies, subsidiaries or business units, and may disclose personal information for the purposes of such a transaction.  These purposes may include, as examples, permitting such parties to determine whether to proceed or continue with the transaction, fulfilling any reporting or audit requirements to such parties, and/or disclosing personal information as part of concluding a sale or transfer of assets. Our successors and assigns may collect, use and disclose your personal information for substantially the same purposes as those set out in this Privacy Policy.
  • Protection of Our Services and Others: We reserve the right to release personal information to unaffiliated third parties when we believe its release is appropriate to comply with the law, enforce or apply our Terms of Use and other agreements, or protect the rights, property or safety of Dominion, our users or others. This includes exchanging information with other unaffiliated third parties in connection with fraud protection and credit risk reduction.
  • With Your Consent: Other than as set out above, you will receive notice and have the opportunity to withhold consent when personal information about you might be shared with unaffiliated third parties.
  • User Submissions: If you participate in any online forum/communities, chat sessions and/or blogs, or otherwise post in any user comment field visible to other users of our Services, any information that you submit or post will be visible to and may be read, collected or used by others who use our Services.  We are not responsible for any information, including personal information, you choose to submit in any such user comment field.

 

Third Party Sites; Advertising

Our Services may contain links to other websites or services not owned or operated by Dominion.  Because we cannot and do not control how such third party sites collect or use your personal information, such sites are not governed by this Privacy Policy and we encourage you to review the applicable privacy policy provided by each third party website before you submit your personal information. 

Our website and apps may also include social media features, such as the Facebook react button and widgets or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie or web beacon to function properly. Your interactions with these features are governed by the privacy policy of the social media company providing such feature.

Finally, we sometimes partner with third party ad networks or use third party vendor re-marketing tracking cookies to display advertising on our website or to manage our advertising on other sites.  Our third party partners may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests. If you wish to opt out of interest-based advertising, please follow the instructions provided in the “Privacy Choices” section of this Privacy Policy.

Do Not Track Signals/Global Privacy Control

Certain websites and other technology can track their users over time to, for instance, provide targeted advertising.  Do Not Track mechanisms and Global Opt Out/Global Privacy Control options allow Internet users to control, and where desired, prevent, the tracking of their online activities across such websites and technology.  Our services currently do not support the Do Not Track browser or any Global Opt Out/Global Privacy Control option. Please see the “Privacy Choices” section of this Privacy Policy for more information on how you can manage how your data can be used by us and/or third-party service providers.

Your California Privacy Rights

If you are a California resident, you may have the right to request and receive information about disclosure of your personally identifiable information to third parties for their direct marketing purposes. Because it is our policy not to share your personally identifiable information with third parties for third party direct marketing purposes without your consent, we are exempt from the requirement to respond to such requests. Canada’s Anti-Spam Law

Commercial electronic messages that are sent from or accessed in Canada, including emails and text messages (“CEMs”), are governed by Canada’s Anti-Spam Law and its relevant rules and regulations (“CASL”). CASL requires that any CEMs sent to Canadian recipients in connection with our Services comply with certain consent and informational requirements (generally speaking, CASL prohibits sending CEMs to Canadian recipients without the prior consent of the recipient).  Consent may either be implied (which is temporary) or express (which is permanent, unless and until withdrawn).  Examples of implied consent to receive CEMs include (i) your having purchased something from us within the past two years, (ii) your download of software included within our Services or (iii) your giving us your business card at a trade show.  You provide express consent when you affirmatively elect to receive CEMs in response to a clear solicitation to do so (for instance, filling out a form on one of our websites where the form clearly states that you will receive CEMs from Dominion).  When applicable, Dominion will ask for your express consent to receive CEMs, and will respect your decision.  Under any circumstances, however, you have the right to withdraw your consent — whether express or implied — by completing our Email Opt Out Form or by contacting us via the contact information provided below.

Data Security

We have in place what we believe to be reasonable physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access of, maintain data security for, and correctly use the personal information you have provided. While such efforts are intended to ensure the confidentiality of your personal information available to us as a result of your use of our website, we cannot and do not warrant or guarantee the absolute safety and security of your personal information.

Opt-Out of Sharing

Except where we believe the release of your personal information is necessary or appropriate (a) to allow third party service providers to perform functions on our behalf or (b) to comply with law, enforce or apply our Terms of Use and other agreements, or protect the rights, property or safety of Dominion, our users or others, you may opt out of our sharing your personal information with unaffiliated third parties by completing our Email Opt Out Form.

Unsubscribe from Communications

You may also unsubscribe from email communications from us, please enter your email address and select the name of the applicable Dominion business from the list on our Email Opt Out Form.

Correct Your Information

You may obtain information regarding the personal information that you provide or we collect about you via our Services for the limited purpose of viewing and correcting any factual errors in such information. Access to personal information that you provide or we collect via our Services may be accessible for a limited period of time after the point of collection. For example, if you created a password-protected account within our Services, you may return to that portion of the Services to review the personal information you provided. Children’s Privacy

Our Services are not intended for (and we do not knowingly collect data from or about) minors under the age of 18.  Each Service is directed to individuals who are permitted to share their personal information without parental consent.  If you believe we might have information from a child under the age of 18, please contact us as directed below in the “Contact Us” section.
